This Addendum supplements and is incorporated into the production, booking, or service agreement (the “Agreement”) between AGUYB Studios (“AGUYB,” “we,” or “us”) and the client identified on the booking confirmation (“Client”). It governs whether and how AGUYB may use materials produced during Client’s session(s) for portfolio, marketing, and promotional purposes. Client selects one tier at the time of booking. That selection applies to all work product from the engagement unless the parties agree otherwise in writing.

Definitions

  • “Work” means any photo, video, audio, or written content captured, produced, or edited by AGUYB during Client’s booked session(s), including raw footage, edited deliverables, behind‑the‑scenes material, and excerpts or stills drawn from any of the above.
  • “Portfolio Use” means displaying, publishing, reproducing, or distributing the Work (in whole or in edited excerpt) on AGUYB’s website, social media accounts, sales and marketing materials, award submissions, case studies, pitch decks, and similar self‑promotional contexts. Portfolio Use does not include selling the Work as a standalone product or licensing it to a third party for their own commercial use.
  • “Release Date” means the date, if any, on which a Confidential Client’s publication hold lifts, as agreed in writing between the parties.

Choose Your Tier

You’ll select one of the following at booking. If no tier is selected, Standard Client applies by default.

Standard Client

AGUYB may use the completed Work and selected excerpts for portfolio, website, social media, advertising, awards submissions, presentations, and case studies, without further notice to or approval from Client.

Confidential Client

AGUYB may not publish any portion of the Work until Client provides written approval or until the agreed Release Date, whichever comes first. Once approval is given or the Release Date passes, this tier converts to Standard Client terms for the approved material.

No‑Publicity Client

AGUYB receives no promotional or portfolio rights to the Work. AGUYB may not use, display, or reference the Work, Client’s name, or Client’s brand in any portfolio, marketing, or promotional context unless separately authorized by Client in a signed writing.

General Provisions

  • No compensation. No fee, credit, or royalty is owed to Client for Portfolio Use permitted under this Addendum unless separately agreed in writing.
  • No editorial control implied. Tier selection is a grant of usage rights only. It does not give Client approval rights over how AGUYB edits, captions, or presents the Work for Portfolio Use, except where the Confidential Client tier requires written approval before any publication.
  • Attribution. Where practical, AGUYB will identify the Client, brand, or production only in a manner consistent with the selected tier and any naming instructions Client provides in writing.
  • Underlying ownership unaffected. This Addendum grants usage rights for promotional purposes only. It does not, by itself, transfer copyright ownership of the Work between the parties.
  • Duration. Rights granted under the Standard Client and (once released) Confidential Client tiers continue after the engagement ends and are not time‑limited unless the parties agree otherwise in writing.
  • Amendment. Client may change tiers, or restrict a specific piece of Work regardless of tier, by written notice to AGUYB at guybertho@aguybstudios.com. The change applies prospectively and does not require AGUYB to remove material already published in good‑faith reliance on the prior tier.
  • Third parties appearing in the Work (e.g., Client’s guests, employees, or talent) are addressed separately under the Agreement’s talent‑release terms, if any, and are not covered by this Addendum.
